The Supreme Court is examining how States appoint their Directors General of Police (DGPs), using the directions in the Prakash Singh case as the yardstick. According to legendofficers.com, Jharkhand is at the centre of the hearing in New Delhi, but the Court has now asked for details of the arrangements followed by all States.

### Key points

- Amicus curiae Raju Ramachandran told the Court that Jharkhand's DGP appointment rule goes against the Prakash Singh directions.
- Similar rules exist in Uttar Pradesh and Punjab, according to the amicus.
- The Court asked for a comprehensive report on the systems followed by different States.
- The serving DGP of Jharkhand has been allowed to file her counter-affidavit by November 16, 2026.

## The Jharkhand rule and the serving DGP

Senior advocate Raju Ramachandran, who is assisting the Court as amicus curiae, said the Jharkhand rule on DGP appointment is contrary to the Prakash Singh judgment. The Court had also expressed a prima facie view to this effect in its order of October 8, 2026.

In that order, the Court observed that if the rule is found invalid, the appointment of the present DGP would also have to be set aside. The State was asked to serve notice on the officer so that she could appear before the Court. Jharkhand was also given the choice of revisiting the rule or filing its response.

During the latest hearing, counsel submitted that Tadasha Mishra, the serving DGP, was appointed a day before her retirement and has remained in the post for around eight to nine months since. The submission was that a retired officer, who was otherwise ineligible, continued as the State police chief.

Senior advocate Kapil Sibal, appearing for Jharkhand, said he had spoken to the Chief Secretary and that the State would examine the matter before filing an application or affidavit. The DGP has appeared through counsel and will file her response.

## A wider look at other States

Mr Ramachandran said he has already submitted his report on Jharkhand. He added that he had looked at similar arrangements elsewhere and found rules like Jharkhand's in Uttar Pradesh and Punjab. He noted that Uttar Pradesh, despite having such a rule, has told the Court in its affidavit that it continues to follow the Prakash Singh directions.

The amicus said it would not be appropriate to examine the Jharkhand rule alone, because the Court's decision could affect other States with similar provisions. The Chief Justice asked him to submit a comprehensive report pointing out deficiencies in the systems used by different States, covering both legislative and executive arrangements.

The Court also discussed the need to find out whether States have passed separate laws, framed rules or issued executive orders, and whether these are actually being followed. Mr Ramachandran referred to an application filed by Prashant Bhushan on behalf of Prakash Singh seeking such details from the Union government and the States.

## What happens next

The Court agreed that the Union government could provide a consolidated account of the existing legal and executive frameworks across States and asked it to file replies. Solicitor General Tushar Mehta agreed to this.

The Registry has been directed to accept the amicus's comprehensive note and share it with counsel for all parties. The matter will be examined in the light of the amicus report, the State government's response and the DGP's counter-affidavit.
