The order was passed on 5 November in Hyderabad.

The case was brought by an MBBS graduate.

MBBS is a medical degree, and his college was still holding his original documents after he finished the course.

The documents included his school and college marks memos, his NEET rank card, and his transfer and migration certificates.

NEET is the national medical entrance test.

### Key points

- The court said the college has no legal right to hold the original certificates over unpaid fees.
- The student could not pay about ₹11.75 lakh of his final-year tuition, but he completed the course.
- The college and its principal must return the documents within one week of receiving the order.
- The fee dues themselves were not decided, so the college can still try to recover them through legal steps.

## What went wrong in this case?

The student had paid about ₹47.5 lakh for the first four years of the course.

He then could not pay the balance for his final year because of money problems.

He still finished the course.

He got a provisional certificate from the university and completed a one-year compulsory internship.

He also registered with the Telangana Medical Council.

But his application for the original degree certificate was still shown as pending with the principal.

## Why does this matter for students?

His lawyer told the court that he had not been able to get permanent medical registration or a job for about a year.

Without the originals, he could not complete the verification needed for NEET PG 2026 counselling.

NEET PG is the national entrance test for postgraduate medical courses.

Counselling is the process of choosing a college seat after the test.

The court said that even if the college is owed money, it must use the proper legal route.

Holding a student's papers as security is wholly unlawful, the court said.

## What happens next?

The court allowed the petition and directed the college and its principal to return the certificates within one week.

No costs were awarded to either side.

The university opposed the petition through its lawyer.

The order does not say what will happen if the documents are not returned within the week.

It also does not decide the fee dues.
