The Uttarakhand High Court has dismissed two income tax appeals filed by the Mussoorie Dehradun Development Authority, ruling that money collected by the authority for an infrastructure fund forms part of its taxable income. The appeals related to assessment years 2006-07 and 2007-08, according to a report by Tax Guru.

### Key points

- The High Court held that the development authority cannot claim exemption from Union taxation under Article 289 of the Constitution.
- Infrastructure development fees collected by the authority were held to be its own income.
- Money actually spent on infrastructure development is deductible, but the unspent balance is taxable.
- Both appeals were decided together and dismissed against the authority.

## What the dispute was about

The authority was set up under the U.P. Urban Planning and Development Act, 1973\. It argued that it performs State functions and should therefore be treated like the State for the purpose of Article 289, which deals with exemption of State property and income from Union taxation. It also argued that the infrastructure contributions it collected under government directions should be excluded from its income under the doctrine of diversion of income by overriding title.

For assessment year 2006-07, the Assessing Officer found that ₹11,63,38,117 had been credited to the infrastructure fund. Of this, ₹3,14,12,303 had been spent on development activities. The unspent balance of ₹8,49,25,814 was added to the authority's taxable income. The authority's challenges before the Commissioner of Income Tax (Appeals) and the Income Tax Appellate Tribunal did not succeed.

## Reasoning of the High Court

The High Court relied on the Supreme Court's decision in Adityapur Industrial Area Development Authority vs Union of India. It compared Section 17 of the Bihar Industrial Area Development Authority Act, 1974, with Section 58 of the U.P. Urban Planning and Development Act, 1973, and found the two provisions substantially similar.

The Court held that the authority is a separate corporate body with its own legal identity, assets and liabilities, and that it can sue and be sued. Its property and funds would pass to the State Government only if it were dissolved under the relevant provisions. The Court therefore said the authority's income cannot be treated as the State Government's income just because the authority was created by State law or carries out public functions. The exemption under Article 289 was not available.

On the infrastructure fund, the Court rejected the argument that government directions on collecting and using the contributions amounted to a diversion of income by overriding title. It held that the fees were the authority's income. Expenditure actually incurred on infrastructure development can be deducted when working out taxable income, and the rest is taxable.

## Other observations and outcome

The Court also noted that the authority had widened its case before the High Court beyond the ground it had raised before the Tribunal. It said this was an additional reason to dismiss the appeals.

The appeals had been admitted to decide substantial questions of law. These included whether "State" under Article 289 covers statutory authorities set up to carry out State obligations, and whether levies collected under the 1973 Act count as the authority's income under the Income Tax Act, 1961\. Applying the Adityapur ruling, the High Court answered these questions against the authority and dismissed both appeals.
